Privacy policy

This policy explains what personal data we collect when you apply to AINI Academy, what we use it for, where it is stored and how you can exercise your rights over it.

1. Who processes your data

AINI — Instituto de Inteligencia Artificial para América Latina y el Caribe (“AINI”) is the controller of the personal data we collect through the website ainilac.com: the AINI Academy application form, the calendar you use to schedule your admission interview, and the enrollment form used to issue your payment receipt.

You can contact us at info@ainilac.com for any matter related to your personal data.

2. What data we collect

Through the application form we collect the data you provide yourself, which may include:

  • First and last name.
  • Email address and phone number.
  • The organization or company you work for and your job title.
  • Information about the project you want to develop and about your team.
  • Any other data you choose to include in the form's open fields.

3. Data we collect when you schedule and enroll

When you book your admission interview, the calendar collects your name and email address, and records the date and time you chose together with the time zone you are scheduling from. That calendar belongs to HubSpot, the same platform where your application is already stored: no provider other than those named in this policy is involved.

When you complete your enrollment, we also collect the data needed to issue your payment receipt: first and last name, email, phone, and the type and number of your identity document. This data is used for the sales receipt or invoice and to identify your payment; your card details are processed directly by Mercado Pago and AINI never receives or stores them.

We also store where you are in the process—whether you applied, whether you scheduled your interview and whether your payment is confirmed—to show you your progress and so as not to ask you for the same thing twice.

4. Browsing data

When you visit the website, technical browsing data—such as your IP address, browser type and the pages visited—is recorded through the cookies and tracking system of HubSpot, the platform we use to manage applications.

Consent to these cookies is managed through HubSpot's own mechanism. You can reject them or withdraw your consent at any time, and also block or delete cookies in your browser settings. Rejecting them does not prevent you from applying.

5. What we use your data for

We process your personal data for the following purposes:

  • To evaluate your application to the cohort and decide on your admission.
  • To contact you to arrange and hold the admission interview.
  • To send you details of the price, the payment options and the enrollment process.
  • To manage your participation in the program if you are admitted, including access to the sessions, materials and communication channels.
  • To send you information about the free open classes and future cohorts, provided you have given your consent to it and until you withdraw it.

6. Legal basis for processing

Processing is based on the free, prior, express, informed and unequivocal consent you give when you submit the application form, under Article 5 of Law No. 29733, and on the performance of the contractual relationship that arises if you are admitted.

You can withdraw your consent at any time, without retroactive effect, by writing to us at the address given below.

7. Where it is stored and who processes it

Your data is stored and processed in HubSpot, a customer relationship management (CRM) platform that acts as data processor on AINI's behalf. HubSpot, Inc. is headquartered in the United States of America, so the processing involves a cross-border flow of personal data as provided for in Law No. 29733 and its regulations.

HubSpot processes the data only in accordance with our instructions and under the contractual security and confidentiality commitments of its own data processing agreement.

We do not sell, assign or transfer your personal data to third parties for commercial purposes.

8. Payment and billing data

If you are admitted and decide to enroll, two separate third parties are involved, each with its own purpose and with the minimum data that purpose requires.

Mercado Pago processes the payment. When you complete the enrollment form, we pass on to it your first name, last name, email, phone, and document type and number, which its platform needs to carry out the transaction. You enter your card details directly in its secure environment: AINI never receives or stores them.

Mercado Pago stores and processes that data outside Peru, so the transaction involves a cross-border flow of personal data as provided for in Law No. 29733 and its regulations, for the purpose of carrying out the payment you yourself initiate.

eCash (RUC 20601795311, with its address at Los Geraneos 166, distrito de Lince, provincia y departamento de Lima, Perú) issues the payment receipt, a task AINI has delegated to it. It receives only what is strictly necessary to issue it: name or company name, identity document or RUC, and the details of the transaction.

This processing is for the purpose of performing the contractual relationship and complying with the applicable tax and accounting obligations. It does not include your application data or the information about your project.

If you apply and do not enroll, your data never reaches this stage.

9. How long we keep it

We keep the data from unsuccessful applications for a maximum of two (2) years from receipt, so that we can tell you about future cohorts, unless you request its deletion (cancellation) sooner.

The data of admitted people is kept for the duration of the program and for the additional period required by the applicable tax and accounting legislation.

10. Your rights

Law No. 29733 grants you the rights of access, rectification, cancellation and objection (ARCO rights) over your personal data, as well as the rights to information, to objective processing and to prevent your data from being supplied.

  • Access: to know what data of yours we process, for what purpose and to whom we have disclosed it.
  • Rectification: to correct your data when it is inaccurate or incomplete.
  • Cancellation: to request the deletion of your data when it is no longer necessary or you withdraw your consent.
  • Objection: to object to a specific processing activity on legitimate grounds.

11. How to exercise them

To exercise any of these rights, write to us at info@ainilac.com stating the right you wish to exercise and attaching a copy of your identity document, so that we can verify that the request comes from the data subject.

We respond to access requests within twenty (20) business days, and to rectification, cancellation and objection requests within ten (10) business days, counted from receipt, in accordance with the deadlines in the regulations of Law No. 29733.

If you believe we have not handled your request properly, you can file a complaint with the National Authority for Personal Data Protection of the Ministry of Justice and Human Rights.

12. Security

We apply reasonable technical, organizational and legal measures to protect your personal data against unauthorized access, loss or alteration, in accordance with the requirements of Law No. 29733 and its regulations.

No security measure is infallible. If we detect an incident that significantly affects your personal data, we will inform you and take the appropriate corrective measures.

13. Minors

AINI Academy is aimed at people 18 and over. We do not knowingly collect personal data from minors through the application form.

14. Changes to this policy

We may update this policy to reflect legal changes or changes in our processes. The version in force is always the one published on this page, with its last-updated date. Substantial changes are communicated by email to the people whose data we are processing.
